The Promotion and Regulation of Online Gaming Act, 2025

Act No. 32 of 2025 received presidential assent and was published in the Gazette on 22 August 2025. Section 1(3) required a later notification to appoint the commencement date, so publication and commencement were not the same event.

The Act defines an online money game by reference to payment of money, fees or other stakes in expectation of monetary or other enrichment, subject to the text and exceptions in the Act. It also addresses relevant services offered within India from outside India. Applying those words to a particular service or page requires legal analysis.

Commencement on 1 May 2026

S.O. 1994(E), notified on 22 April 2026, appointed 1 May 2026 as the date on which the Act came into force. The Promotion and Regulation of Online Gaming Rules, 2026 were notified through G.S.R. 303(E), and rule 1(2) states that the Rules came into force on the same date.

Offering, promotion and financial facilitation

Sections 5 to 7 address offering online money games or related services, promotion or advertising that induces play, and specified financial facilitation. The exact words, definitions and exceptions in the Act control; a short summary cannot resolve how the provisions apply to every page or service.

What the 2026 Rules add

The Rules set out procedures and implementation detail, including classification or determination, specified registration processes, user-safety features, grievances, appeals, penalties and publication of determined online money games. Read the notified document for the complete wording and schedules.

Access does not decide how the law applies

Litigation and later developments

A Supreme Court order dated 19 December 2025 in W.P.(C) No. 1239/2025 records a challenge to the Act and the issue of notice. The order linked below does not decide the merits and does not state that the Act was stayed. Later filings, connected matters and subsequent orders require a fresh docket check by Indian counsel.
